Conditions to be imposed on the Licence

1. All activities as licensed above under sections C, E, F, G, I, J, L and M shall not take place on more than ten days, being Monday to Saturday inclusive, within any calendar month.

2. A register of all events under condition (1) to be held and maintained by Monson Road Working Mens Club and made available for inspection by the Local Authority and the Surrey Constabulary.

3. All CCTV recordings taken at the premises shall be retained for not less than 14 days and made available for inspection by the Local Authority and Surrey Constabulary.

Reasons for the Decision

1. It was noted that representations had been received from 15 residents and that there was one speaker against the application. No representations were received from the Police or Environmental Health. Specific note was taken of the objections in respect of the prevention of public nuisance.

2. The Sub-Committee took into account the Council's own Statement of Licensing Policy, the Guidance issued by the Secretary of State under s.182 of the Licensing Act 2003, the individual merits of the case, Human Rights legislation and the rules of natural justice.

3. The Sub-Committee considered that the application, as granted with conditions, met the four licensing objectives.
30 APPLICATION FOR A NEW CLUB PREMISES LICENCE:
Reigate Heath Golf Club, Flanchford Road, Reigate

The Sub-Committee RESOLVED to GRANT the application as set out below:

Provision of Regulated Entertainment (sections B, E, F, G and J) to be:

12h00 to 00h00 Friday and Saturday
12h00 to 22h00 on Sunday

Supply of Alcohol for consumption on and off premises (section L) to be:

Opening Hours (section M) to be:

Seasonal Variation for all above activities to be until 02h00 on New Year's Eve.

Conditions to be imposed on the Licence

1. No more than 30 events per calendar year.
2. No more than two events in any seven day period.
3. The Licensee shall ensure that any music provided at the premises shall not cause a disturbance to local residents. From 23h00 any music shall be inaudible in any residential property, the test of which is that it shall be no more than barely audible at the boundary of any residential property.

Reasons for the Decision

1. It was noted that only one representation had been received and that the responsible authority for Environmental Protection had reached agreement with the applicant subject to a condition to be attached to the licence.

2. The Sub-Committee took into account the Council's own Statement of Licensing Policy, the Guidance issued by the Secretary of State under s.182 of the Licensing Act 2003, the individual merits of the case, Human Rights legislation and the rules of natural justice.

3. The Sub-Committee considered that the application, as granted with conditions, met the four licensing objectives.

29The Sub-Committee considered an application for a variation to the club premises certificate in respect of the above premises. The report before the Sub-Committee set out full details of the application, together with copies of the representations received from local residents.

The application was for:

• permission to hold indoor sporting events (section C)
• provision of live music indoors only (section E)
• provision of recorded music indoors only (section F)
• performance of dance to take place indoors (section G)
• provision of facilities for making music indoors only (section I)
• provision of facilities for dancing indoors only (section (J)
• supply of alcohol for consumption on and off the premises (section L)

In addition, non-standard timings were being sought as set out in the application.

The hearing followed the procedure as set out in the annex to the agenda.

The Licensing Officer presented the application before the Sub-Committee.

The applicant's counsel then presented the application on behalf of the applicant.

In the course of his presentation it was noted that the variation of the licence was being sought in order to meet the needs of members and their guests.

The main emphasis of the applicant's presentation was upon the need for the morning extension in order to allow flexibility in the services offered. Members had expressed an interest in having line dancing and in being able to hold band rehearsals or the like, to be able to perform in front of other members in the evenings.

The applicant was mindful of residents' concerns and the night extension was of a lesser concern.

No complaints had been received by the Club itself, although it was aware that the Licensing Officer had a record of five complaints, two in 2006 and three in 2007. The police had only been involved in one of the complaints.

One objector to the application attended the meeting and made representations.

The objector reiterated the points made in her letter and commented upon noise issues associated with the club. In particular she made reference to taxis slamming their doors and blocking the road and to fights outside in the past.

The objector's main concern was the application for an evening extension and it was noted that there was recourse to appeal and review of the licence if complaints were received by the Local Authority.

The Sub-Committee put questions to the applicant and to the objector.

It was noted that the Club was both soundproofed and double glazed. The Club did not intend to make full use of the extensions applied for but wished to have flexibility so that it could offer a wider choice of services based on demand. The applicant's counsel confirmed that the applicant would be content to have a limit set for the number of daytime events that could be held within a calendar month.

It was also noted that the Club's existing licence allowed it to open on a Sunday evening but that it did not currently choose to do so.

The type of indoor sporting events the Club wished to offer were darts and snooker, as well as the opportunity for Members to watch the forthcoming Football World Cup.

The applicant was mindful of residents' concerns and sought to strike a balance between the needs of the Club whilst recognising that residents were entitled to peaceful enjoyment of their property.

30The Sub-Committee considered an application for a new club premises certificate in respect of the above premises. The application was as set out in the report and accompanying papers.

One representation had been received from the responsible authority for Environmental Protection, however, agreement had been reached with the applicant in the course of mediation. The relevant correspondence was circulated to the Sub-Committee, from which it was noted that the parties had agreed to the imposition of the following conditions in order to overcome the objections raised:

1. No more than 30 events per calendar year.
2. No more than two events in any seven day period.
3. The Licensee shall ensure that any music provided at the premises shall not cause a disturbance to local residents. From 23h00 any music shall be inaudible in any residential property, the test of which is that it shall be no more than barely audible at the boundary of any residential property.

In accordance with the Council's licensing procedures, the Sub-Committee was thereby requested to approve the mediated application.
